Sponsorship and Eligibility

This Sneakers ‘Old Town’ Sweepstakes (the “Sweepstakes”) is sponsored by The Giving Tree Wellness Center of North Phoenix, LLC (the “Company”), located at 21617 North 9th Avenue, Phoenix, AZ 85027. There is no purchase necessary to enter or win. This sweepstakes is open to legal residents of Arizona twenty-one (21) years of age or older at the time of entry. This sweepstakes is void where otherwise prohibited or restricted by law. Employees of the Company, its affiliates, licensees, franchisees, advertising and promotional agencies, and the immediate family members of each are not eligible.

Qualification Periods

Qualification period begins at 12:00 AM (MST) on June 9, 2022, and ends at 11:59 PM (MST) on June 16, 2022.

Entry Procedures

To enter the sweepstakes, you must submit your first name, last name, birth date, residential zip code and valid email address to the web-based form available by scanning the QR code in the advertisement or visiting sneakasmoke.com/sneakers-old-town-scottsdale-sweepstakes/. You can also enter by United States Postal Service by sending a postcard with your first name, last name, residential zip code and valid email address to Attn: Sneakers Sweepstakes, 21617 North 9th Avenue, Phoenix, AZ 85027. All entries must be postmarked no later than June 16, 2022.

Duties of Participants; Limitation of Liability

By entering, participants agree to be bound by these rules and the decisions of the Company, which shall be final. All federal, state, and local laws apply. The Company and its employees, officers, directors, members, agents, and representatives of the Company, affiliates, subsidiaries, and advertising, promotion, and legal advisors, and any employees and agents of such affiliates, subsidiaries, and advertising, promotion, and legal advisors, are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in calculations or transmission; (iv) any condition caused by events beyond the control of the Company that may cause the contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the sweepstakes; or (vi) any printing or typographical errors in any materials associated with the sweepstakes.

Violation of Contest Rules

The Company reserves the right to disqualify any participant or winner who, in its sole suspicion, tampers with the entry process, fraudulently submits more than a single entry, violates these Terms and Conditions, or acts in a non-cooperative or disruptive manner.

Selection of Winners; Chances of Winning

The prize will be awarded in a random drawing held from among all eligible entries received. Odds of winning depend on the total number of entries received.

Prize Drawing

The prize drawing will consist of one (1) $250 Nike gift card to be redeemed at Nike.com.

Notification of Winners; Substitution of Prizes

The winner of the grand prize drawing will be announced on Instagram @sneakasmoke on or about June 17, 2022, and will be contacted at the email address they submit. If the winner does not respond to the announcement by direct message or the email within three days of its transmission, the prize will be forfeited and an alternate will be selected at random. The winner of the prize drawing pursuant to Section 3 may not substitute or transfer prizes. The Company reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable. Prize is not redeemable for cash. Any valuation of the prize stated above is based on available information provided to the Company. The value of any prize awarded may be reported for tax purposes as required by law. A prize winner is solely responsible for reporting and paying all applicable taxes related to the prize and paying any expenses associated with any prize, which are not specifically provided for in the official rules. A prize winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes, including gift cards, from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

Permissions

Except where prohibited by law, participation in the Sweepstakes constitutes permission to use a winner’s name and likeness for online posting or any other advertising and publicity without additional compensation. A winner may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize.
